RUMORS ON NEW LAW IPC 233 AGAINST RAPE IN INDIA

Rumors on IPC-233


From actual Act IPC 233
Whoever makes or mends, or performs any part of the process of making or mending, or buys, sells or disposes of, any die or instrument, for the purpose of being used, or knowing or having reason to believe that it is intended to be used, for the purpose of counterfeiting coin, shall be punished with imprisonment of either description for a term which may extended to three years, and shall also be liable to fine.

But Rumor is like this "BREAKING NEWS: Finally a new law passed. Indian Penal Code 233 If a girl is suspected to be raped, or getting raped, then she has the supreme right to kill the man, injure his sexual part or harm that person as dangerously, that girl wont be blamed for murder."

This has been started appearing on social networking sites or as messages.The law is under consideration and not yet passed. It will be discussed in the parliament at the next session (most likely in the end of Jan'2013)

Just to acquaint everyone about it:

  Laws are passed by the central government after it gets an approval from the state governments. Now, is it going to really approved by all the states?? The reason being there are so many MPs (Member of Parliaments) who have rape charges against them. Are they going to allow the law to get approved. If the law is approved, are these MPs will be punished according to the new law.

  Have our government fooled the public by just giving the news on new law consideration? is it going to stretch its approval for years and years? will Indian public forget after couple of months about this new law, and wait for another "Damini" to face something similar and again protest.... What about the 6 people who acted worst than animals in the Delhi gang rape case? They are yet to be hanged?? They deserve to be killed brutally and they are still alive...   What about the Govt. officials and politicians who also have rape charges against them??

I believe, there are three categories of men who does rape.

First category may be having some kind of nerve problem. (probably we can say that they do have a mental issue) May be the circumstances he grown up made him like that. He will never think whether the victim is 5 year old or 50 year old.

Second Category can be having political/money power. These people will think that money/political power can save him from any case/crisis. 

Third category do this basically because of some filthy friends and under control of alcohol. Such group of friends may be having some thought like "If we are together, we can do anything". Under the control of alcohol they do such things without any forecast.

In most of the cases, the main villain will be Alcohol. In normal condition they do think about after impacts. We cannot say that due to the lack of sex workers they are doing rape. In Delhi, you can easily get a sex worker as compared to the availability in Kerala. Still in both place girl is not at all safe.  

You can't make a law simply to hang the victim. There are possibilities like The woman who have some revenge on a person can easily make use of the law for destroying her enemy. So the law should be scientific and there shouldn't be such type of loop holes.

IN INDIA WOMEN ARE RESPECTED ONLY IN SPEECH,NEWSPAPER AND IN BOOKS TO SHOW WORLD HOW GREAT INDIA IS BUT THE ACTUAL FACT IS "GANG RAPE IN BUS" AND "RAPE OF 5 YEAR GIRL BABY" THESE ARE WHICH WE KNOW WITH THE HELP OF MEDIA . According to IPC 375 and the new section 376A, the rapist will get rigorous imprisonment for a term which shall not be less than twenty years, but which may extend to imprisonment for life, which shall mean the remainder of that person’s natural life, or with death." In case of "gang rape", persons involved regardless of their gender shall be punished with rigorous imprisonment for a term which shall not be less than twenty years, but which may extend to life and shall pay compensation to the victim which shall be reasonable to meet the medical expenses and rehabilitation of the victim. BUT THESE LAW WILL REMAIN IN PAPER. THE PEOPLE WHO HAVE MONEY/POLITICAL POWER WILL EASILY ESCAPED FROM ANY KIND OF PUNISHMENT. THEY WILL EVEN TORTURE THE VICTIM'S FAMILY.

    4. Read the fact about world... americans also do this... Rape doesnt only happen in India, its everywhere.. search for news about most of American College going girls never go to police for sexual harassment and rape.. do your research, its free online.. Rape is not just India's problem, its a common crime against women in all over the world.. You are right we do need a strong law in India.. its also a fact that US has strong laws against rape but still rape happens and US is on the top list in "crime against women".. Women in India do have a respected place; but its the mentality of people to disrespect women all the time.. It is also a fact that in many cases women are behind the crime against women...

  3. Ambinu vs: I agree with ur last point. Therefore i would have a counterview in this subject. Undoubtedly, the rapist has to be punished with rigorous imprisonment or similar capital punishment..but if the law gives authority to a girl as mentioned in the rumour IPC 233 or similar extreme laws where the girl holds authority to punish, this law can be misused rampantly. One has to see on the negative impact of the same. Any girl (with malintentions) can misuse the law...When the laws are framed, those need to be done full proof without any loopholes left, so that the needy or the genuine victim can make full use of the law and avail speedy and complete justice, so that this law should not be used as a legal weapon for revenge. A perfect example of misuse is 498 A where many cruel/cunning wives use that section as a legal extortion tool.

    1. That is very crucial. Anyway while making the rule, we should close all the loop holes that leads to misuse of the law. Nowadays women are enemy of the girls who got trapped into the sex racket. Nobody can raise voice against such type of filthy creatures. According to the law, police can take charge on anybody by just accepting the word said by a woman without any evidence. That is why every sex racket will have at-least one such type of woman. They are even ready to sell their blood relation.

  8. Section 100 Indian Penal Code provides the right of private defence of body causing death of the offender which seems more near to the rumour.More sections on private defence are also on http://surfpolice.blogspot.com/‎

  9. But India has passed a law where the assault on the testicles proves fatal the person will be charged with murder. There was a case I read of a girl who squeezed the sex glands (testicles) of a 15 year old boy who tried to rape her. He unfortunately died but why is she charged with the murder ?

No law needs to be passed as it is already a part of Indian law Read Section 100 which extends the right of private defence and moreover section 233 is part of chapter 12 and this cannot be added to the former part though latter can be added in chapter relating to offences against human body chapter 16 of IPC or in General Exceptions Chapter 4 IPC ....
